Terms of Service
LAST UPDATED · 14 OCTOBER 2026These Terms of Service ("Terms") govern your use of Tallyr, a digital loyalty and stamp-card platform available at tallyr.com.au and app.tallyr.com.au ("Tallyr", "the Service", "we", "us").
Tallyr is owned and operated by EMEI PTY LTD (ABN 63 686 497 469), trading as Tallyr, of 7 Stanthorp St, Burnside Heights VIC 3023, Australia.
By creating an account or using the Service, you agree to these Terms.
1. Who these Terms apply to
Businesses ("Merchants"): owners and staff of businesses that use Tallyr to run a loyalty program.
Customers ("Members"): people who hold a digital stamp card issued by a Merchant through Tallyr.
Sections 2 to 9 apply mainly to Merchants. Section 10 applies to Members. Everything else applies to everyone.
2. The Service
Tallyr lets Merchants create digital stamp cards, share them with their customers by QR code or link, stamp visits, and manage rewards through a dashboard. Cards live in the Member's phone through our web app and, where available, digital wallets. With the Wallet nudges add-on, Merchants can also send messages to their Members through the Member's wallet pass.
We may improve, add or change features at any time. If we make a change that materially reduces the Service you pay for, we will tell you in advance.
3. Accounts
You must provide accurate information when creating an account and keep your login details secure. You are responsible for activity under your account. Merchants may give staff members access to stamp cards; the Merchant is responsible for their staff's use of the Service.
You must be at least 16 years old to create an account.
4. Plans, pricing and billing
- Free plan: no charge, and no card required. It includes one business, one location, up to three staff members and Basic analytics, for up to 1,000 active customers (Members who collected a stamp or redeemed a reward at your business in the last 90 days). The customer limit is a soft limit: if you go over it, Members are never turned away and nothing stops working — we will let you know and invite you to upgrade.
- Tallyr Pro: $25 AUD per month. This covers up to two businesses and two locations in total, unlimited staff members and customers, and Advanced analytics. Beyond those limits, each additional business is $10 AUD per month and each additional location is $5 AUD per month.
- Wallet nudges add-on: $10 AUD per month, available on either plan. It turns on messages sent to your Members through their Apple Wallet or Google Wallet pass on your behalf: automated reminders (when a reward is close, when it is ready, and when a Member has not visited for a while), messages you write yourself, a birthday message, and a Google review request after a number of visits you choose. We limit how often each Member receives messages from your business. Members can opt out of messages from your business at any time.
- All prices are in Australian dollars. Tallyr is not currently registered for GST, so no GST is charged.
- Paid plans and add-ons have no trial period. You are charged when you upgrade or add an add-on, and then monthly in advance, through our payment provider, Stripe. By subscribing you authorise recurring monthly charges until you cancel.
- If a payment fails, we will tell you and try again, and your account keeps working while we do. If the payment still cannot be collected, your account moves to the Free plan. Nothing is deleted: you choose which business and which location stay active, anything else beyond the Free plan's limits is paused until you upgrade again, and Members can still see their cards and redeem rewards they have already earned.
- We may change our pricing with at least 30 days' notice. Changes take effect at your next billing cycle after the notice period.
5. Cancellation
There is no lock-in. You can cancel Tallyr Pro or an add-on anytime from the app or by contacting us; cancellation takes effect at the end of your current billing period, after which your account continues on the Free plan. See the Refund Policy below for refund terms.
6. Merchant responsibilities
As a Merchant, you are responsible for:
- Your rewards. You set your own stamp rules and rewards, and you are solely responsible for honouring rewards that Members earn. Tallyr provides the platform; the reward is a promise between you and your customer.
- Your conduct with customer data. You must only use Member data collected through Tallyr for running your loyalty program, and you must comply with the Privacy Act 1988 (Cth) and any other laws that apply to your business. That includes any copy of your Member list you download from Tallyr: keep it secure, and delete it when you no longer need it.
- Your messages. You are responsible for the messages you send through Tallyr. They must be accurate, you must honour any offer in them, and they must comply with the Australian Consumer Law and any other law that applies to you, including the Spam Act 2003 (Cth). Tallyr gives every message a way to stop it that needs no sign-in, and honours a request to stop within five working days. You may use them only to promote your own business.
- Review requests. You must not offer or give a Member anything in exchange for a review, or ask only the Members you expect to be happy for one. Google's policies prohibit both, and Tallyr never attaches an offer to a review request.
- Stamps added by hand. Stamps you add to a Member's card by hand must reflect a genuine purchase or visit, or correct a genuine mistake. Tallyr records who added them and the reason given.
- Your content. Your business name, logo and card designs must be yours to use and must not infringe anyone's rights or contain unlawful or offensive material.
- Lawful operation. Your loyalty program must comply with the laws that apply to your business and industry.
7. Acceptable use
You must not: misuse or attempt to disrupt the Service; access it by automated means without our consent; reverse-engineer, decompile or tamper with the Service or its software; use it to send spam; upload malicious code; misrepresent your identity or business; harass or abuse other users, Merchants or our staff; or use the Service for any unlawful purpose. We may suspend or terminate accounts that breach this section.
8. Intellectual property
We own the Tallyr platform, software, brand and design. You own your business content (your name, logo, card designs and your customer relationships). You grant us a licence to display your content within the Service so we can provide it to you and your Members. Neither of us gains ownership of the other's property under these Terms.
If you send us suggestions or feedback about the Service, we may use them to improve Tallyr without any obligation to you.
9. Data
Your Member list and loyalty data belong to your business. We host and process it to provide the Service, as described in our Privacy Policy. We do not sell it and we do not show advertising against it. On Tallyr Pro you can download your Member list from the app at any time. If you close your account, you may request an export of your Member data within 30 days of closure, after which we may delete it.
10. Members
If you hold a stamp card through Tallyr:
- Your card, stamps and rewards are issued by the Merchant, not by Tallyr. Questions about a reward should go to the business that issued the card.
- Rewards have no cash value and cannot be exchanged for money.
- We provide the platform with care, but we are not responsible if a Merchant changes, withdraws or fails to honour a reward, or closes their program or business.
- A Merchant whose card you hold may send you messages through that card, as described in our Privacy Policy. You can turn them off for any Merchant at any time in the app.
- Your personal information is handled as described in our Privacy Policy.
11. Availability and support
We aim to keep the Service available at all times but do not guarantee uninterrupted access. Maintenance, updates or events outside our control may cause downtime. Support is provided by email at info@tallyr.com.au, and we aim to respond promptly during Australian business hours.
12. Consumer guarantees and liability
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or any other law that cannot lawfully be excluded.
Subject to that:
- The Service is provided "as is" to the extent the law allows.
- To the maximum extent permitted by law, our total liability for any claim connected with the Service is limited to the amount you paid us in the 12 months before the claim arose, and we are not liable for indirect or consequential loss, loss of profit, or loss of data caused by events beyond our reasonable control.
- Where liability cannot be excluded but can be limited, our liability is limited to resupplying the Service or paying the cost of resupply.
13. Termination
We may suspend or terminate your account if you materially breach these Terms and do not fix the breach within 14 days of notice, or immediately for serious misuse. You may close your account at any time. Sections that by their nature should survive (including 8, 9, 12 and 15) survive termination.
14. Changes to these Terms
We may update these Terms from time to time. If a change is material, we will notify account holders by email or in the dashboard at least 14 days before it takes effect. Continuing to use the Service after that date means you accept the updated Terms.
15. General
These Terms are governed by the laws of Victoria, Australia, and the courts of Victoria have jurisdiction. If any part of these Terms is found invalid, the rest still applies. These Terms are the whole agreement between us about the Service.
Refund Policy
LAST UPDATED: 2 OCTOBER 2026
Tallyr has a Free plan, one paid plan (Tallyr Pro) and one paid add-on, all monthly and with no lock-in, so our approach is simple.
1. Plans
- Free: no charge, and no card required.
- Tallyr Pro: $25 AUD per month — covers up to two businesses and two locations in total. Beyond those, additional businesses are $10 AUD each per month and additional locations are $5 AUD each per month.
- Wallet nudges add-on: $10 AUD per month, on either plan.
- Paid plans and add-ons have no trial period: you are charged when you upgrade or add an add-on, and then monthly in advance.
2. Cancelling
You can cancel Tallyr Pro or an add-on anytime from the app or by contacting us. Cancellation takes effect at the end of your current billing month, and you keep full access until then. After that there are no further charges and your account continues on the Free plan; there is no lock-in. Removing a business or location takes effect from your next monthly invoice; we do not charge or refund part-months for changes made within a month.
3. Refunds
Because plans are transparent and cancellable, we do not generally refund billing periods where the Service was provided as described.
We will always provide a refund or other remedy where the Australian Consumer Law requires it, including where the Service has suffered a major failure. For a major failure you may cancel the Service and receive a refund for the unused part of your subscription, or keep the Service and seek compensation for any drop in its value. Nothing in this policy limits your rights under the Australian Consumer Law.
4. Billing mistakes
If you believe you have been charged in error (for example, charged after cancelling), contact us at info@tallyr.com.au and we will investigate promptly and refund any amount charged in error.
Please contact us before initiating a chargeback with your bank; charging back a valid subscription payment without contacting us first may result in suspension of your account while the dispute is resolved.
